These Terms & Conditions (“Terms”) govern your access to and use of the Website and any associated short-term rental services (collectively, the “Services”).
By accessing the Website or booking a stay with us, you agree to comply with these Terms. If you do not agree, do not use the Website or make a reservation.
Defined Terms
The following terminology applies throughout these Terms, our Privacy Policy, and any other agreements or policies:
- “Guest,” “you,” or “your” refers to any person who accesses the Website or reserves a stay with the Company.
- “Company,” “we,” “us,” or “our” refers to KactiKarma Lombardy, LLC, doing business as The Lombardy House.
- “Parties” refers collectively to both the Guest and the Company.
All terminology includes singular and plural, capitalized forms, and all gender expressions interchangeably.
1. Property Overview
The Lombardy House operates a duplex located in Charlotte, North Carolina. Each unit is fully furnished and available for short-term rental. Specific amenities are described in your reservation confirmation.
2. Booking & Payment
- Full payment is required to confirm your reservation.
- Taxes, cleaning fees, and a refundable security deposit apply.
- The Company reserves the right to pass through third-party payment processing fees (e.g., Stripe or similar platforms), which may include a percentage and/or fixed charge per transaction. These fees, if applicable, will be clearly itemized and may be non-refundable.
3. Check-In & Check-Out
- Check-in: 4:00 PM
- Check-out: 10:00 AM
4. House Rules
Guests must follow the house rules below. Violation may result in immediate eviction and forfeiture of any payments made:
- No pets allowed
- No smoking inside the property
- No parties, events, or unauthorized guests
- Quiet hours: 10:00 PM to 8:00 AM
- Maximum occupancy must match the reservation
- No walking or parking on the lawn
- No tampering with Wi-Fi, smart locks, smoke/CO detectors, or security cameras
- No open flames, candles, or fireworks
- No damage to walls (e.g., no nails, screws, or adhesives)
- No subletting or third-party listings
- No commercial use, photography, or filming without prior written consent
5. Guest Responsibilities at Check-Out
- Before departing, Guests must:
- Remove all food and beverages from the refrigerator, pantry, and freezer
- Remove all personal items, clothing, and laundry from closets, drawers, washer, and dryer
- Bag and dispose of all trash in outdoor bins
- On Tuesday evening, place trash and recycling bins at the curb; bring them back in on Wednesday morning
- Leave the unit in clean and orderly condition to avoid additional cleaning charges
6. Digital Access & Security
- A private access code will be provided for entry.
- Sharing access codes with anyone not listed on the reservation is strictly prohibited.
- Tampering with smart home or security systems may result in immediate eviction.
7. Parking Disclaimer
Driveway parking and street parking are available. Street parking is at your own risk.
The Company is not responsible for citations, towing, damage, or theft involving vehicles parked on the street.
Guests must comply with all local parking laws and signage.
8. User Comments & Content
Parts of the Website may allow users to post comments or content. We do not filter or review content prior to posting. Comments represent the opinions of the user and not the views of The Lombardy House. We reserve the right to remove inappropriate or unlawful comments.
By posting content, you warrant that:
- You have the right to post the content
- It does not violate any intellectual property or privacy rights
- It is not defamatory, offensive, or unlawful
- It will not be used for advertising or commercial solicitation
You grant The Lombardy House a non-exclusive license to use, reproduce, and edit any comments or content you submit.
9. Intellectual Property
Unless otherwise noted, all materials on the Website are the intellectual property of KactiKarma Lombardy, LLC or its licensors. All rights are reserved.
You may access the Website for personal, non-commercial use only. You may not:

We are not responsible for delayed or undelivered messages caused by carriers, internet outages, or service interruptions. Guests remain responsible for reviewing all booking details sent to the email address provided at reservation, even if SMS delivery fails.
You may opt out of SMS at any time by replying STOP. For assistance, reply HELP.
13. Limitation of Liability
Use of the Website and property is at your own risk. The Company is not liable for:
- Injury, illness, theft, or loss
- Internet outages, utility failures, or weather disruptions
- Parking violations, damage, or theft involving vehicles
Nothing in this section limits our liability for death, personal injury, or fraud where such limitation is not permitted by law. Our maximum liability is limited to the amount paid for your booking.
14. Dispute Resolution
Disputes will be resolved in the following order:
- Informal negotiation
- Mediation
- Binding arbitration in North Carolina in accordance with AAA rules
We reserve the right to seek court action for eviction, injunctive relief, or unpaid balances.

17. Accessibility Statement
The Lombardy House consists of two two-level duplex units. Each unit has bedrooms and bathrooms located on the second floor. As such, all guests must be able to walk up and down a flight of stairs in order to sleep and/or access restrooms during their stay. Unfortunately, the units are not wheelchair accessible and may not be suitable for guests with mobility limitations.
